Terms of Service

1. Agreement
These terms cover Tinselwood, a Christmas town-building game for Windows ("the game"), made by Clackety Rock ("we", "us") and sold on Steam. By playing it, you agree to them. If you do not, please do not play it; section 3 covers refunds.
You play through a Steam account, so you have also agreed to Valve's Steam Subscriber Agreement. These terms sit beside it and do not replace it. Valve's rules, not ours, decide who may have a Steam account (people aged 13 and over).
2. What you are buying
Buying the game gives you a personal licence to install and play it through your Steam account, on any computer you use that account on, for as long as you keep to these terms. It is a licence to play, not ownership of the game itself: its code, artwork, models, music and name belong to Clackety Rock and are not yours to copy, resell or redistribute.
The game is built with open-source software and fonts, which stay under their own licences. Every one of them is listed, with its notice, on the open-source licences page.
3. Price, purchases and refunds
You buy the game from Valve, not from us. Payment, tax and refunds are handled by Valve, under the Steam Subscriber Agreement and Steam's refund policy. We never see your payment details, and we cannot issue a refund ourselves.
The price on Steam is the whole price. There is nothing to buy inside the game: no in-game currency, no loot boxes, no ads. Anything offered for sale, now or later, is sold on the Steam store and nowhere else.
Achievements, and anything else you unlock, exist only inside the game and have no monetary value.
4. Your towns
There are no accounts of ours. Your towns are saved as plain files on your own computer and are yours to keep, copy, back up, edit, share or delete. We never receive them, so there is no permission for you to grant us and nothing of yours that we could publish.
Steam Cloud keeps a copy of your save folder under your Steam account unless you turn it off. That copy is held by Valve, on Valve's terms.
You may delete a town at any time from Load Town in the game. The game keeps its own launch-time backups on your computer for a while afterwards, so a town deleted by mistake can often be put back. The Privacy Policy says exactly what is stored, and where.
5. Postcards, screenshots, streams and videos
Pictures and footage of your towns are yours. You are welcome to post them, to stream the game, and to make videos about it, including ones you earn money from through a platform's ordinary programmes (ads, subscriptions, tips).
Two requests: do not pass the game off as your own work, and do not suggest that we endorse or sponsor you unless we do.
6. A few things not to do
Please do not:
- copy, resell or redistribute the game, or any part of it;
- pull the artwork, models, music or code out of the game to use somewhere else;
- remove or hide any copyright or licence notice;
- reverse engineer the game, except where the law where you live says you may.
The open-source parts are the exception: their own licences say what you may do with them. So are your save files. They are yours, so open them, edit them and share them as much as you like; a town that stops loading because of it is yours to mend.
7. Updates
The game is updated through Steam. Updates can add, change or remove features. They are made with care for the towns you already have, and the aim is always that an existing town opens in a new version, but see section 8, and back up anything you would hate to lose. The save folder is plain files, and the Privacy Policy says where it is.
8. Availability and warranty
The game is provided "as is", without warranties of any kind, whether express or implied, including fitness for a particular purpose. There is no promise that it will be error-free, that it will run on every computer (the store page lists what it needs), or that saved data will always be preserved.
Nothing in these terms takes away rights you have under the consumer law where you live. Where that law gives you a guarantee that cannot be excluded, you have it.
9. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental or consequential losses arising from your use of the game, including lost towns or lost time, and our total liability to you is limited to the amount you paid for the game. Nothing in these terms limits liability that cannot lawfully be limited, and some places do not allow certain exclusions, so parts of this section may not apply to you.
10. Ending things
You may stop playing and delete your towns whenever you like. The game runs entirely on your computer and depends on no servers of ours, so there is nothing for us to switch off. If the game is ever withdrawn from sale, the copies already in Steam libraries are Valve's to look after, under the Steam Subscriber Agreement.
Your licence lasts for as long as you keep to these terms, and ends if you break section 6.
11. Changes to these terms
These terms may be updated as the game grows. The effective date at the top will change, anything that matters will be mentioned in the game's update notes on Steam, and continuing to play after an update means accepting the revised terms.
12. Governing law
These terms are governed by the laws of the Commonwealth of Massachusetts, United States of America, without regard to conflict of law rules. If you are a consumer living somewhere whose law gives you the right to rely on your own country's consumer protections and courts, that right is not affected.
